## Canberra tree removal rules (ACT Urban Forest Act 2023)
- **Governing law**: The Urban Forest Act 2023, which replaced the Tree Protection Act 2005.
- **Protected by height**: A tree on leased (private) land in the ACT is protected once it reaches 8 metres or taller.
- **Protected by canopy**: Also protected once the canopy spreads 8 metres or wider.
- **Protected by trunk size**: Also protected at a trunk circumference of 1 metre or more, measured 1.4 metres above natural ground level.
- **Dead native trees**: A dead native tree is protected at a trunk circumference of 1.88 metres or more at 1.4 metres above ground.
- **Also protected**: Any tree on the ACT Tree Register, and any tree planted in the last 5 years under a canopy contribution agreement.
- **Approval needed**: Removal, major pruning, lopping or groundwork inside the tree protection zone needs an approved tree activity application. Building and driveway work can instead use a tree management plan.
- **If removal is approved**: A canopy contribution agreement, and sometimes a tree bond before work starts, can apply.
- **Penalties**: Up to $80,000 for an individual and $405,000 for a corporation, plus on-the-spot fines.
